General Terms and Conditions
INTRODUCTION
The following General Terms and Conditions (hereinafter: GTC) contain the terms of use related to the use of the shalabuda.com website operated by Vitaguide Kft. as a service provider, and the general terms and conditions related to the services it provides.

By using the shalabuda.com website or by registering or making a payment, the user of the site acknowledges that they have read and understood the following rules (including the privacy policy) and consider them binding, which, as an agreement between the parties, is not considered a written contract and is created solely in electronic form. The rules and conditions set out in these GTC apply to all online email or telephone services of shalabuda.com.
Vitaguide Kft. (hereinafter: Service Provider), as the owner and operator of the shalabuda.com website, reserves the right to modify these GTC at any time in the future. The modified terms of use shall enter into force on the date of publication on the shalabuda.com website. The user acknowledges the modified GTC by using the site again.
The date of entry into force of these GTC is: 05.08.2024.
TERMS USED IN THE GTC
Parties: Service Provider and User together.
Service Provider: Vitaguide Kft., as the operator of the The Shala Buda yoga studio and the shalabuda.com website.
User: A person who initiates a purchase through the Service Provider's website and enters into a contract by starting the purchase.
Contract: A purchase agreement between the User and the Service Provider concluded through the use of the shalabuda.com website and electronic mail.
Consumer: A natural person acting outside their trade, business, craft, or profession who has visited the place or website operated by the Service Provider.
Business: A person acting in the course of their trade, business, or profession.
Consumer agreement: A contract where one party, the buyer, is a consumer.
Products/services: services listed in the shalabuda.com website and price list, as well as any tangible movable property put into circulation and offered for sale by the Operator that may be the subject of the contract.
REGISTRATION AND PURCHASE
The services indicated on the Service Provider's website can be used by making a reservation on the shalabuda.com site by providing the mandatory data, and purchasing on the Service Provider's website is only possible by completing the agreed payment.
Registration for each user account can only be done with a valid email address.
Following registration, the User will receive an email to the email address they provided, requesting confirmation of the registration. By clicking on the link in the confirmation email, the User finalizes their registration, and from that moment on, they are entitled to use all the services of the website. The Service Provider provides the User with a password for their user account.
The User is obliged to keep their password confidential and to immediately notify the Service Provider if their password has been brought to the attention of a third party, or if an unauthorized third party has accessed their email inbox, or if any other confidential information has become accessible to strangers. By making the User's username and password available to a third party, the User agrees that this third party may act as the User's authorized representative in using the Service and website, or in making reservations. The User is responsible for any consequences of failing to keep the password confidential.
The personal data provided during registration may only be used by shalabuda.com for its own purposes, in accordance with the Privacy Policy, and may only be transferred to third parties at the request of the law or authorities.
Following successful registration on shalabuda.com, Users can initiate reservations and pay for services online.
Following a reservation for the use of a particular service, the Service Provider shall immediately send an electronic confirmation to the User who has made the reservation. If, due to a malfunction of the technical devices used by the User, the User cannot access their user account, the confirmation shall still be deemed to have been received.
On the shalabuda.com site, the Service Provider details the name and description of its services, as well as their price. The services displayed can be ordered online from the shalabuda.com website, or in person or by phone. The prices displayed for the services are in HUF and are gross prices (i.e., they include the statutory VAT, or, if the Service Provider invoices without VAT, the prices are the amounts to be paid).
Following registration, the User can order the selected Product/Service by clicking on the "Basket" button next to the name of the service and placing it in the Basket, then selecting the payment method. Placing the Product/Service in the Basket does not constitute a final purchase. The User can finalize their purchase by clicking on the "Pay" button and making an online payment. Payment can be made by credit card or through the PayPal cash-free payment system on the shalabuda.com website.
By submitting the order, the User acknowledges that they have a payment obligation. After submitting the order, the website will redirect the User to the payment page.
Users pay the full price of the service by bank card transfer or online via the PayPal system to the Service Provider's PayPal account as follows:
After selecting the Product/Service, shalabuda.com will redirect the User to the PayPal page in the final phase of payment, where Users can choose from the following payment options:
If the User already has a PayPal account, they only need to log in, then review the payment details and approve and pay the full amount by transfer. If the User does not yet have a PayPal account, they can first create one, or
pay the full amount to the Service Provider's PayPal account by online bank transfer after providing their personal and credit card data to the bank service provider.
Following the successful submission of the order, the User will receive an electronic confirmation by email. If this confirmation does not reach the User within a reasonable time depending on the nature of the service, but no later than 48 hours after the User has submitted the order, the User is released from the offer or contractual obligation. The order and its confirmation shall be deemed to have been received by the Service Provider and the User when it becomes accessible to them. The Service Provider disclaims responsibility for confirmation if the confirmation does not arrive on time because the User provided an incorrect email address during registration or because their mailbox is full and cannot receive messages.
Following successful payment, the User will receive an electronic invoice or receipt for the paid service within 48 hours by email, along with a coupon/day ticket/pass entitling the User to use the purchased service. The User expressly accepts the electronic issuance of invoices and electronic performance by the Service Provider, and acknowledges that they will not be sent in paper form. The Service Provider's ticket and pass products are also available in electronic form during online purchases and have no other physical form. The purchased conditions will also be uploaded to the User's account.
Purchased passes do not have an automatic start date, only a pre-specified, mandatory start deadline. The Service Provider always publishes the maximum period for starting a given pass product, which is 30 days, which may vary in the case of individual promotions. This determines how much time the purchasing User has to start the desired pass service.
The User acknowledges that the day ticket is only valid for the day of purchase or for a day specified by the User and entitles them to enter once a day. Passes purchased must be started within 30 days of the date of purchase and are valid for 10 weeks/91 days/182 days/365 days depending on the type. Users expressly acknowledge that passes and tickets are non-transferable. The user can only purchase the type of pass for which they are eligible and can prove (e.g., student pass can only be purchased with a valid student status).
Within 14 days of paying for the service used, the User has the right to withdraw from the purchase, in which case the service fee paid will be refunded to the User. If the User wishes to withdraw from the contract after 14 days of paying for the pass, or if they have participated in any hour at the expense of the pass, the service fee paid will not be refunded.
DATA PROTECTION
The Service Provider respects the User's personal data and handles the Users' personal data in accordance with applicable laws and the provisions of the Privacy Policy. The Service Provider shall only disclose personal data to third parties with the consent of the Users or at the request of the law or authorities.
Users can modify their data after registration, but in this case, shalabuda.com will store the User's previous data in accordance with the privacy policy for the duration of the user's entitlement.
The Service Provider is not responsible for the possible loss of data transmitted on the internet by Users during the use of the shalabuda.com website.
The Service Provider reserves the right to share the Users' personal data with its employees and authorized representatives. The detailed rules of data processing carried out by the Service Provider are contained in its privacy policy.
COMPLAINT HANDLING
The Service Provider is obliged to keep a record of any complaints from Users at the location indicated in the Service Provider's data and to keep the complaint together with its response for five years from the date of recording. The Service Provider shall examine the complaint and give a substantive response within 30 days of its receipt. If the Service Provider rejects a complaint, it must give a written explanation. Disputes arising from the binding contract between the Service Provider and the consumer can primarily be settled amicably between the parties or through the consumer protection authority responsible for the consumer's place of residence.

LEGAL STATEMENT
In addition to the statutory liability for damages, the Service Provider and the User shall be liable for damages in connection with the performance of the purchased products and services only in cases attributable and culpable to them. The parties exclude any further claims for damages to the extent permitted by the applicable law.
shalabuda.com and Vitaguide Kft., the operator of the website, reserve all rights regarding shalabuda.com, any of its details and the content appearing on it, and the distribution of the website. All content, descriptions, graphics, and images on shalabuda.com are the exclusive property of Vitaguide Kft. The Website constitutes a collection as defined in Section 7 of Act LXXVI of 1999 on Copyright and is protected by copyright.
It is prohibited to make any copies of the content on shalabuda.com in any form, to record them in either analog or digital form, to reproduce, distribute, transmit, download, edit, resell, or publicize them.
The use of any content of the Website in any form, whether for commercial or other purposes, is only possible with the prior written consent of the Service Provider. Any material from the shalabuda.com website and its database can only be taken over with written permission by referring to shalabuda.com as the source. It is particularly prohibited to download, store and use any data, dates, prices, any part or all of the database from the website in an automated or other way, except in expressly authorized cases. shalabuda.com and Vitaguide Kft. will take all civil and criminal steps to terminate such proceedings and remedy the infringements caused.
Unless otherwise specified, the software required to use the services and the content, information, and materials displayed on the website are the intellectual property (including copyrights) of Vitaguide Kft.
Any disputes regarding these rules and conditions and the services provided by the Service Provider shall be litigated exclusively before the competent Hungarian courts.
